What Do You Say About These Canadians?

Court overturns father's grounding of 12-year-old
    14 hours ago

OTTAWA (AFP) — A Canadian court has lifted a 12-year-old girl's grounding, overturning her father's punishment for disobeying his orders to stay off the Internet, his lawyer said Wednesday.

The girl had taken her father to Quebec Superior Court after he refused to allow her to go on a school trip for chatting on websites he tried to block, and then posting "inappropriate" pictures of herself online using a friend's computer.

The father's lawyer Kim Beaudoin said the disciplinary measures were for the girl's "own protection" and is appealing the ruling.

"She's a child," Beaudoin told AFP. "At her age, children test their limits and it's up to their parents to set boundaries."

"I started an appeal of the decision today to reestablish parental authority, and to ensure that this case doesn't set a precedent," she said. Otherwise, said Beaudoin, "parents are going to be walking on egg shells from now on."

"I think most children respect their parents and would never go so far as to take them to court, but it's clear that some would and we have to ask ourselves how far this will go."

According to court documents, the girl's Internet transgression was just the latest in a string of broken house rules. Even so, Justice Suzanne Tessier found her punishment too severe.

Beaudoin noted the girl used a court-appointed lawyer in her parents' 10-year custody dispute to launch her landmark case against dear old
    dad.
Quebec Superior Court meow its purely remind me of the Scandinavian system, that its not your children, they're the State's children.

That's disgusting. I'm sorry but many of today's kids just need a good beating to set them straight.

I mean actual discipline and moderate spanking never hurt a kid. This kind of stuff is what actually hurts children. Talk about growing up to become misguided adults with no sense of self-discipline or accountability.

There is no doubt in my mind that the girl's lawyer did this out of her interest in the child's welfare, and not for the publicity eyes:

And some wonder why people don't have as much respect for the law as they used too.

I place the blame squarely on the mother. Without the mother becoming so involved, the "minor" would have been angered by the father's "grounding" but she would have gotten over that.

This is a broken family situation that obviously has continued bad blood between the divorced parents. Remember, the father has custody. The mother should have supported the father's decision because it was not unreasonable but that would have been too easy.

No rod, no beatings but just firm, consistent discipline, from an early age.

    By both parents!!!!!!

    Just my 2 cents.

    BAH ! That's what I say.

The child is bring used as a pawn in a legal battle between the parents. The issue here isn't whether the child's punishment is justified by the nature of her offense(s) but rather to "get back at" the father by attempting to stymie his efforts to discipline the child.

Unfortunately, the court is right because the father prevented his daughter to use one of the elementary freedoms we have in our societies:freedom of movement. It's the consequence of universal human rights and it's also the right consequence to free her from being grounded but is it really good for raising a child? I fear that she was already raised in a wrong way if she really went to court with that and did the stuff she was accused of.
