    The reference to gender will disappear from Belgian identity cards, the Mediahuis group media reported on Tuesday. In this way the registration of “non-binary” people will be made possible.

    In 2019, the Constitutional Court annulled provisions of the transgender law of June 25, 2017, deemed unreasonably restrictive and therefore discriminatory. The Court considered that the retention of binary categories, male or female, for the registration of sex in the birth certificate was incomplete.

    The federal government intended to resolve this unconstitutional aspect, but it was not clear how to proceed at this stage.

    The abandoned genre “X”

    One option was to determine a gender with the sign “X“on an identity card. But in the end the government decided to drop the reference to gender that had appeared in 2003 on the identity card, according to a political note for 2022 submitted to the House.

    The Ministers of Justice, Vincent Van Quickenborne (Open Vld) and of Home Affairs, Annelies Verlinden (CD&V) as well as the Secretary of State for Equal Opportunities, Sarah Schlitz, jointly prepared a bill for this respect.

    The entry will remain in the national register

    However, it is more a question of invisibility of the gender of the card holder because it is a personal information. On the other hand, gender will not disappear from the national register where it can be modified in the event of a gender transition.

    Home Affairs still has to look into technical aspects, in particular the impact of this abolition on travel and the distribution of this new card. “As soon as the last technical aspects are clarified, we want to implement this quickly.“, assures Jessika Soors, spokesperson for Ms. Schlitz.
