    'Nazi Grandma' Holocaust Denier Ursula Haverbeck Sentenced to Jail

    An 87-year-old woman has been sentenced to prison after she claimed that Jews were never exterminated in Auschwitz. Her criminal record includes two fines and another sentence for sedition.

    A court in Detmold on Friday sentenced Ursula Haverbeck to eight months in jail on charges of sedition. The presiding judge ruled out the possibility of parole and said that Haverbeck had a lack of "any kind of respect" and that she had made more offensive comments in the courtroom.

    Haverbeck is expected to appeal against the sentencing. In Germany, anyone who publicly denies, endorses or plays down the extermination of Jews during Adolf Hitler's regime can be sentenced to a maximum of five years in jail.

    Haverbeck was found guilty of writing a letter to Detmold's mayor, Rainer Heller, saying it was "clearly recognizable" that Auschwitz was nothing more than a labor camp. She wrote her message at the time when the Detmold court was trying Reinhold Hanning, a former guard who served at the Auschwitz concentration camp.

    German 'Holocaust Denier' Haverbeck Again Sentenced to Prison

    A well-known German neo-Nazi has been convicted again of Holocaust denial and sentenced to prison, but is showing no signs of changing her views. Ursula Haverbeck in her closing statement in Verden district court Monday talked of the "Auschwitz lie" and said the infamous death camp was actually a labor camp where nobody was killed by gas, the dpa news agency reported. She'd been charged with Holocaust denial, a crime in Germany, for the content of several articles she wrote for a magazine called the Voice of the Reich. Haverbeck, 88, said she'd appeal her conviction and two-and-a-half year sentence. She's currently free as she appeals other convictions from courts in Detmold and Lueneburg.

    There they admit that it is actually about the ladies views AND NOT about "incitement of racial hatred".

    German court rejects 'Nazi grandma' appeal, as it rules Holocaust denial is not covered by free speech

    German holocaust denier Ursula Haverbeck has been sentenced to two and a half years in prison after the country's highest court ruled that denying the mass murder of Jews during Nazi Germany is not covered by the right to free speech and "threatens public peace".

    Haverbeck, who is known as the 'Nazi-Grandma', was convicted last May for publishing a series of articles in which she insisted that the Holocaust and murder of Jews at Auschwitz concentration camp in Poland are not "historically proven".

    In Germany, denying the Holocaust constitutes a crime of incitement to hatred and carries a prison sentence of up to five years.

    The 89-year old went to Germany's constitutional court to appeal her sentence, claiming that her statements fall under the country's right to free speech, which is protected by law.

    But in their ruling, the high court judges found that the right to free speech does not protect the denial of the Holocaust.

    "The dissemination of untrue and deliberately false statements of fact can not contribute to the development of public opinion and thus do not fall in the remits of protection for free speech", the judges wrote in a statement.

    "The denial of the Nazi genocide goes beyond the limits of the peacefulness of public debate and threatens public peace," they added.'

    Pretty run of the mill situation in this world as it is run by the "chosen". I am terribly saddened by the fact for certain, I am in no way being complacent. It makes me very sick we have come to this. Why have free speech when you can decide a particular discussion is not 'covered'?

    They're running out of our folk to put behind bars, so they're still after the elderly. Then it's the relatives of those who have passed. When and how the hell is it going to stop?

    I cannot think of a single historical or scientific phenomenon that cannot be questioned in the modern West, other than the 'Holocaust'.

    You can say the Earth is flat ... that no one ever landed on the moon ... that Japan won the second World War ... or that you can fly out the window if you flap your arms really fast ... and you will simply be thought of as ignorant and laughed off. But dare question if the modern estimates of Jewish causalities between 1941 and 1945, and the manner in which they died ... and off to the old cell you go! It's quite remarkable, and lacks comparable judicial practices since the end of the Medieval witch trials.

    This is not a "free speech" issue, this goes much deeper, the paragraph for "incitement" effectively denies scientific research of the subject. (((They))) made it law that the "holohoax of sixmillionjews is obvious", and questioning or just researching it (see Germar Rudolf, who had to flee Germany) comes with up to 5 years.

    Every historian should be up in arms about such a law, but of course, those who dare to voice their concerns are fired from their jobs.

    All other things apart and regardless of the subject, what kind of statement is this to begin with: "The dissemination of untrue and deliberately false statements of fact can not contribute to the development of public opinion and thus do not fall in the remits of protection for free speech", the judges wrote in a statement."

    a) Since when is to "contribute to the development of public opinion" a precondition necessary to deem something free speech?

    b) "untrue statements". Since when is the truth of a statement, yet another, precondition for it to fall under free speech?

    c) "Deliberately false statements". This would necessitate that she personally believes her statements to be untrue but tells them nevertheless. There is no indication she doesn't believe what she says.

    Volksverhetzung §130 StGB

    The years 1957 - 1959 had some scandals, with synagogues been set on fire ,
    anti-semitic leaflets were handed out , a person named 'Ludwig Zind' had
    boasted about having killed several hundred jews in attendance of a jewish merchant ,
    a synagogue lauded by chancellor Konrad Adenauer been under arson attack and
    700 more occurences of these sorts .

    Since these times the Socialists in the former GDR probably decided to build
    the anti-facist protection wall in 1961 .

    In year 1960 the §130 got the 'Human Honour' added .
    Especially the Social Democrats did not want to make the new wording
    a positive discrimination of jewish persons .


    Since 1994 the Denial of the Holocaust is ruled specifically .
    I had finished my conscription army and civil service in mid-1994 and had
    no TV in my room .
    I have not noticed a change back then .
    Nazism had not been some exceptional theme in my whole Life until then ,
    except probably a few not mend serious Third Reich Jokes and
    the usual Nazi-calling by a few Lefties like one of my younger brothers .

Sie reagierte damit auf eine Serie antisemitischer Straftaten, darunter Brandanschläge auf Synagogen, und Justizskandale. Im Frühjahr 1957 hatte Ludwig Zind, ehemaliges SD-Mitglied, einen jüdischen Kaufmann beleidigt und voller Stolz hunderte Morde an Juden in der NS-Zeit bekannt. Er wurde im April 1958 wegen Beleidigung und Verunglimpfung des Andenkens Verstorbener zu einem Jahr Gefängnis verurteilt, floh aber vor Haftantritt ins Ausland. Im Prozess hatte er seine nationalsozialistischen Ansichten bekräftigt und dafür viel Zustimmung seitens der Zuschauer erhalten. Im Juli floh auch der ehemalige KZ-Arzt Hans Eisele ins Ausland; die KZ-Ärztin Herta Oberheuser wurde vorzeitig entlassen und konnte sich erneut als Ärztin niederlassen.

    Diese und andere Fälle wurden in der deutschen und internationalen Öffentlichkeit aufmerksam registriert. Dabei wurde auch der Fall des Hamburgers Friedrich Nieland bekannt, der 1957 trotz Verbreitung einer antisemitischen Hetzschrift vom Oberlandesgericht Hamburg nicht verurteilt worden war.[7] Weihnachten 1959 kam es dann zu einem schweren Anschlag auf die Kölner Synagoge, die Bundeskanzler Konrad Adenauer erst kurz zuvor mit der jüdischen Gemeinde eingeweiht hatte, gefolgt von 700 Anschlusstaten bis Ende Januar 1960. Dies rief internationale Empörung und Besorgnis über die Stabilität der westdeutschen Demokratie hervor. Die SED sprach von einer „Refaschisierung“ der Bundesrepublik.

    Daraufhin fand am 22. Januar 1960 im Bundestag eine von der SPD beantragte große Justizdebatte statt. Dabei lehnte die Opposition den Gesetzentwurf der Regierung als Sondergesetz ab: Adolf Arndt sprach von einem „Judenstern“-Gesetz, das die jüdische Minderheit rechtlich als privilegiert brandmarken würde. Stattdessen müsse man jede Herabwürdigung von Minderheiten als Angriff auf die Menschenwürde ahnden. Seine Sicht setzte sich im Rechtsausschuss des Bundestages durch, so dass im Sommer 1960 nicht „Aufstachelung zum Rassenhass“, sondern der Angriff auf die „Menschenwürde anderer“ in den Gesetzestext übernommen wurde.[8]

    Holocaustleugnung war bis 1994 schon als einfache Beleidigung strafbar. Der Bundesgerichtshof hatte Menschen jüdischer Abstammung aufgrund ihres Persönlichkeitsrechts in der Bundesrepublik am 18. September 1979 Anspruch auf Anerkennung des Verfolgungsschicksals der Juden unter dem Nationalsozialismus zugesprochen.[9]

    Am 13. April 1994 entschied das Bundesverfassungsgericht, dass Holocaustleugnung nicht unter das Grundrecht der Meinungsfreiheit nach Art. 5 Absatz 1 des Grundgesetzes fällt: Es handele sich bei der Holocaustleugnung um eine „unwahre Tatsachenbehauptung“, also das Bestreiten einer vielfach erwiesenen Tatsache, die für sich nicht vom Recht der Meinungsfreiheit gedeckt sei, da sie nicht zur verfassungsmäßig vorausgesetzten Meinungsbildung beitragen könne.[10] Schon die Prüfung, ob Holocaustleugnung überhaupt als im Sinne der Meinungsfreiheit schutzwürdige Meinung in Betracht kommt, wurde also verneint.
