    Obama Interfering in Arizona Immigration Enforcement

    The Obama administration urged the Supreme Court on Friday to review and set aside an Arizona law that sanctions employers who hire illegal immigrants, saying it would disrupt the "careful balance" that Congress struck in federal immigration law.

    The act in question is not the strict new Arizona law that President Obama and other members of his administration have criticized. That measure requires police to question anyone who appears to be in the country illegally.

    The law being challenged, the Legal Arizona Workers Act, imposes tougher sanctions than federal law for hiring illegal workers. If the court chooses to hear the case, its ruling could show how receptive the justices would be to arguments that enforcing immigration laws is a federal responsibility that cannot be usurped by the states.

    The Arizona act is being challenged by a coalition of organizations that include the U.S. Chamber of Commerce, Hispanic groups and civil libertarians. Business groups want to head off a proliferation of conflicting state laws on employer sanctions, while others worry that the penalties, which include the loss of business licenses, would discourage companies from hiring even those legally in the country.

    The Obama administration, in a brief submitted by Acting Solicitor General Neal Katyal, said federal law should preempt state efforts.

    The Arizona law would "disrupt a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," Katyal wrote.

    The court asked the government in November for its view of the case. The response might have been delayed by two factors. Homeland Security Secretary Janet Napolitano is the state's former governor and was the first defendant when the challenge was filed. And Obama selected Solicitor General Elena Kagan earlier this month as his choice to replace retiring Justice John Paul Stevens.

    Separately, Justice Department officials met Friday in Phoenix with Arizona Attorney General Terry Goddard and aides to Gov. Jan Brewer (R) to express strong reservations about the new law, which goes into effect July 29. The administration fears the law could lead to widespread racial profiling.

    The case the court is considering is Chamber of Commerce v. Candelaria.

    The law in question was inacted before Obama became president - I think it was before he was a candidate. It requires employers to verify that persons they hire are in the country legally. They can do this by verifying the social security numbers potential employees give on thier applications. The social security administration has a database the numbers can be checked against for this purpose (to make the numbers are legitimate, match the name & did not belong to a deceased individual) but it is not mandatory for employers to do so by federal law. When illegals do use fake social security numbers the Social Security Administration keep the tax paid but does not report the deception to the employers or to ICE.

    Wonderful. Not only does this "administration" put more faith in the word of illegal immigrants, but feel that the sovereignty of the states is not important as well. As far as I can tell, the preempting of state law via the supremacy clause only applies in cases where the law in question interferes with federal law. This Arizona law seems to do nothing but strengthen the federal statute.

    I guess its no longer a question of maintaining United States sovereignty as well as that of the states, its a question of unquestioned equality of people. Countries without borders, here we come.

    Come to think of it, it's quite interesting that the American government can pressure the Jamaican government to crack down on drugs and crime to the point where they're sending hundreds of soldiers in the streets; but any state in the United States that uses non-violent & lawful action against a serious criminal threat is being challenged by this very same government.

    ^ Now you know why so many Americans are disgruntled and disapproving of their government.

    Some Americans think that if the GOP has a big win in November it will solve some of their problems. Others( very few ) feel that the current government has not had enough time. Yet others feel we should take our country back from these moronic criminals as the DNC and GOP are both bad.

    The reason (to me) why the current electorate is fighting the Arizona law is very simple. For many years (since the Clinton administration) a bill known as the Universal National Service Act has been in play to be passed. It is the bill to enforce mandatory conscription. I believe I have brought this up before. After its last revision, it granted the ability to legally draft any person (note: not citizen) within the borders of the United States into military service.

    If should be obvious that once any immigration bill is passed by the Federal Corporation, this Act will also be passed.

    Of course the Great Beloved Leader comrade commissar Macaca Hussein Obongo would target a sovereign State's law that helps eliminate the bait for illegal aliens: employment. Employers that hire the invaders should be heavily penalized in what they care about: $$
    If the U.S. government refuses to do its constitutional duty to protect the States from foreign invasion and secure the borders, then the States must take matters in their own hands and ignore illegitamate federal interference until the federals do their duty.
