    ANC 'Owns Shoot The Boer'

    Johannesburg - The ANC owns the struggle song containing the word "shoot the boer" and therefore should be allowed to intervene in a case which may see it outlawed, the South Gauteng High Court heard on Wednesday. "The first point relates to the ownership of the song... proceedings may have the effect of... criminalising that song and this would impact on the propriety... of the ANC," said advocate Vuyani Ngalwana, acting for the ANC. The party is seeking to intervene in a hate speech case brought against ANC Youth League president Julius Malema by Afrikaner rights group AfriForum. The second point raised by Ngalwana was the ANC's right to freedom of expression as enshrined in the Constitution.

    "The second nature of interest rides in freedom of expression that the ANC and its members have," Ngalwana said. The case related to Malema's use of the term "shoot the boer" contained in a liberation song. Ngalwana likened it to the Afrikaner folk song De La Rey. He argued that it would be "the zenith of absurdity" to ban De La Rey. "It is similarly absurd for AfriForum to suggest a struggle song... should be banned because there is this ingrained belief that... black people are susceptible to be incited... to rise up and kill the first white person he sees." Ngalwana said the ANC had a "direct and substantial interest" in the case being heard before Judge Colin Lamont.

    The Transvaal Agricultural Union of South Africa has also applied to intervene in the matter. Its lawyer Loubser van der Walt said the organisation represented farmers who are referred to in the song. "We are more directly influenced by this case than just a normal Afrikaner. We have access to the best statistics about incidents that happened on farms and about the effect of the song on the farming community." AfriForum initially lodged a complaint in the Equality Court last year, but the case was moved to the High Court due to the national interest of the case. On Thursday, Lamont heard argument on the ANC and TAU's application to intervene in the case and not on its merits.

    And they liken a song about the Anglo Boer war to one calling for genocide?! Their average IQ of 66 is reflected in arguments like this. So if they own the song I wonder if they can produce any proof of copyrights? We are on a fast track to the situation in Libya and I will be proud to take up arms for my folk.

    Interesting claim. Does someone have the lyrics of the song in question? Maybe we can learn more about the ANC's intent.

    Just that De La Rey doesn't contain any reference to shoot Brits indiscriminately. It doesn't even call for shooting British soldiers or anyone for that matter.

    He argued that it would be "the zenith of absurdity" to ban De La Rey.
    Right, but this doesn't make the comparison valid.

    The case against Malema is also not about banning a song, but about public incitement to genocide which creates clear, present and immediate danger to cause a breach of public peace, damage to property, or injury to persons.

    You wil notice that it does not have much structure or intelligent lyrics except repeating the same words over and over. They sing about us being cowards and rapists?! It is probably written this way that they will remember the instructions after singing it for the umpteenth time. I would have considered a song like this a joke was it not that it contained such dangerous words. Compare this to the translated version of De La Rey:

    "De la Rey" is clearly a battle song and its lyrics have nothing to do with calling for people to shoot innocent people: I repeat, it is so obviously a battle song that it cannot be compared to the "shoot the boer" song. The ANC advocate, Vuyani Ngalwana, has shown himself to be a complete fool in this instance; there is no comparison between these two songs.

    So it is allright for me to call blacks kaffers then as it is part of my 'heritage'? Our culture is being farmers in a safe environment, smart traders, excellent craftsmen and soldiers. We can't enjoy it because of 'black economic empowerment'. Our Culture is owning guns and enjoying the outdoors, we can do neither today. Owning a weapon is basically illegal and enjoying the outdoors is impossible for you would have to look over your shoulder the whole time as you would probably get robbed or raped at the least. So to hell with their right of heritage as we have none left!

    They destroyed our heritage by tearing down our statues, changing town/street names and by being in the process of disowning farms. They could have created their own prosperity like we did during the nineteen-thirties but they just steal it 'legally'. We did not change town or streetnames neither did we destroy english statues, no we just build our own. Towns like Port Elizabeth, Durban and Port Alfred bears evidence to this. Pietersburg is now called Polokwane, Pretoria Tswhane and Port Elizabeth is now Nelson Mandela bay. All of these cities are being mismanaged since the name changes as it is the only legacy they have. Like all the African nations they can not build but only steal and destroy.

    I hadn't heard the De La Rey song yet which is a shame.
    What a beautiful piece of art which can't be compared to this Shoot The Boer "song"(it actually doesn't even deserve to be called a song) in any way.

    Yes thank you Juthunge, i too hope so. Some days it feel possible, others not- if only all of us could stand as one that would be possible. For that to happen lots of multicult brainwashing needs to be undone though...

    De La Rey was actually written in co operation with Sean Else(Simon Dekker) who did most of the work.

    There is no doubt in my mind that the Afrikaans people would make short work of the kaffirs in South Africa.
    A very strong people, with an inspiring feeling of 'paraat'.
    If the race war would finally openly reveal itself, although for us, it's clear enough. The Afrikaans, in the fighting form of their ancesters, would massacre the blacks like it was Blood river.

    I wouldn't even say that "Kill the Boer" was composed sounds like something which was started by a person chanting the line and then others repeated it and a couple of other lines were thrown in for good measure.

    Not even a battle song more a means of brainwashing violent animals to kill the "correct" people.
    I grew up on a belief of honour, courage and the old world values. The world isn't about that anymore, preferring to die a slow death of fast food and cheap thrills.
