    Is that so? I was always of the impression that the only state with the right to secede at any given time at will was Texas, because it was the only state included in the United Status by a treaty?

    After the civil war, secession was no longer allowed.

    Texas v. White, 74 U.S. 700

    (1869) was argued before the United States Supreme Court in 1869. The Court held in a 5–3 decision that the Constitution did not permit states to secede from the United States, and that the ordinances of secession, and all the acts of the legislatures within seceding states intended to give effect to such ordinances, were "absolutely null". However, the decision did allow some possibility of the divisibility "through revolution, or through consent of the States."

    Ironically, this infatuation with the federal government, and specifically with the judicial branch of the federal government, has actually (at least in part) created the growing enslavement of the people of these States United.

    Certainly we should care about who sits on the US S CT bench. However, the time has come in our Confederate Republic (the USA) to acknowledge and understand that the power to govern ourselves justly and constitutionally is in the hands of the people of the several states of America--NOT in the hands of the branches of federal government. What most people in America have been duped to believe is that the US S CT is the final arbiter in all matters concerning government actions related to the US Constitution.

    I'm one of those modern day secessionists.

    Any of the 50 sovereign American states retains the right to withdraw from the compact that is the U.S. federal union, despite the fact the tyrannical federal government has usurped the powers and liberties of the states that formed it, the states which gave it its enumerated powers in the constitution.
    Because Lincoln forced the Southern states back into the "union" at gunpoint in no way invalidates the American tradition of secession from a government that no longer represents the will of the people it is supposed to serve, and as has happened, becomes an active enemy of our liberties and way of life.
    Acts of secession by 13 individual states from the British crown gave birth to this country before there was any union.

    States do have the right to secede. This right of secession can be exercised, however, only in cases of civil liberties abuse by the Federal or central government. This right of secession was reaffirmed out of the controversy over the Adams administration's Alien and Sedition Laws. Thomas Jefferson himself helped in its formulation. Look to the "Bill of Rights" the central government in Washington tries to take away any of these rights and automatic grounds for secession is established.

    States have tried this before. I hope they do not try it again because no one wants to see brother against brother. We have enough enemies and now is the time to stand together. If people would look at the big picture instead of saying we'll take care of ourselves now (thanks very much for all the help fostering our new country) we could be a better nation. As for Texas i believe our last president claimed residence there and look at the wonderful way he ran our country into the ground!

    Whether or not a state can secede comes down to whether or not the the Federal Government will have the means or the will power to prevent it.

    Well Texas seceded in 1862 & we know how that turned out. What the 1845 treaty of annexation did give to Texas was the right to breakup into 5 states at a later point.


    This shows the extent of Texas in 1845 (at annexation & statehood) & its modern boundaries after 1850 when Texas ceded much of it's western & northern sections (that it had nevered controlled) to the US Government for $10 million.
