    Discrimination and Anti-Discrimination Laws

    DISCRIMINATION against dominant white males will soon be encouraged in a bid to boost the status of women, the disabled and cultural and religious minorities.

    Such positive discrimination -- treating people differently in order to obtain equality for marginalised groups - is set to be legalised under planned changes to the Equal Opportunity Act foreshadowed last week by state Attorney-General Rob Hulls.

    The laws are also expected to protect the rights of people with criminal records to get a job, as long as their past misdeeds are irrelevant to work being sought.

    Equal Opportunity Commission CEO Dr Helen Szoke said males had "been the big success story in business and goods and services".

    "Clearly, they will have their position changed because they will be competing in a different way with these people who have been traditionally marginalised," she said.

    "Let's open it up so everyone can have a fair go."

    Victoria's peak business body expressed concern yesterday about the need for the proposed laws, and questioned if they would undermine the right of companies to make legitimate business decisions.

    At present, individuals or bodies wanting to single out any race or gender for special treatment must gain an exemption from VCAT.

    Companies and public bodies accused of discrimination can only be held to account after a complaint has been made.

    But the proposed changes go much further, allowing the commission to inquire into discrimination, seize documents and search and enter premises after attempts to bring about change have failed.

    Businesses and individuals would be required to change their ways even if a complaint had not been received.

    Action could be taken where an unlawful act was "likely to occur", not just in cases where discrimination has taken place.

    The commission would also have real teeth to enforce its rulings via VCAT and, as a last resort, in the courts.

    The changes, shown in a Department of Justice report by former public advocate Julian Gardner, would also:

    EDUCATE people so they know their rights.

    GIVE more protection to people with disabilities, requiring companies and public entities to reasonably accommodate their needs.

    GRANT the homeless and people who act as volunteers better protection from discrimination.

    Victorian Employers' Chamber of Commerce and Industry workplace general manager David Gregory said business supported the objectives of equal opportunity legislation.

    "But I am concerned and curious about whether these changes mean the commission can second-guess the legitimate business decisions of individual businesses," he said.

    The first raft of changes to the Equal Opportunity Act were introduced into Parliament last week.

    This is great news. I can't tell you how extremely well quotas and positive discrimination go down with men. Even the most politically correct male will start spurting out not-so politically correct opinions when the topic is brought up for discussion. If they want to maintain their multicultopia they better not make the mistake of pissing off us dudes, the consequences will not be pretty.

    Good and bad news, really.

    Helping the disabled achieve a decent semblance of working life is nothing but exemplary.

    The laws are also expected to protect the rights of people with criminal records to get a job, as long as their past misdeeds are irrelevant to work being sought.
    Another good avenue to tread down.

    The vicious circle of crime is partly down to the lack of substantial jobs to provide for oneself and family when the sentence for your crime has been served.

    Obviously the past would have to be vetted in accordance with current laws.


    As for the rest of the proposal, well that is not progress, that is two-steps back with truncheon in its hand.

    Crime should not be reason to get ahead in line for a job, that would just be another way for criminals to take advantage of an already laughably naive and lenient system, which they are experts at doing. Unless we consider criminal acts to be unavoidable and involuntary, and in which case we would need to lock these people up for good after their first offense since they cannot make an active choice by themselves to not commit crimes, the consequences for breaking the law needs to be crystal clear. You break the law and bad things will happen to you, not "you break the law and we'll go easy on you since you deserve our pity and will usher you into employment at the expense of those who obey the law and live decent lives".

    It would and I agree.

    But what the article said was this:

    It doesn't say they will be given preferential treatment in obtaining jobs, but merely protected by the stigma and accusations of their past crimes.
    I then said that the new laws would have to stay within the accordance of current CRB vetting laws.

    You get my point, don't you? Sure, there are some criminals, who after doing their time or paying their penance should not be barred from seeking a job where their criminal record is irrelevant: For example, I can't see where someone who stole a batch of newspapers from a newsagents' would be unable to do security work at a nightclub.

    There are however some crimes where resocialisation, let alone preferential treatment is entirely out of the question. I can't see where the conviction of any sexual predator, be that a rapist or a paedophile would not be relevant.

    If you truly feel that a child-molestor should work at any place where children are likely even to frequent it on a rare basis just because they have been through a "therapy" and a few pledges in an environment lacking children that they won't do it again, then you've seriously got a few screws loose, I am afraid to say.

    The resocialisation attempts of paedophiles and other sexual predators who acted out of conviction and innate feelings usually fail, and even if they don't immediately re-offend they are a ticking time-bomb. Someone who finds children sexually attractive will always be sexually attracted to children, much like you can't therapise away someone's preference for tall, blonde women with blue eyes. Paedophilia is a sexual preference and a perverse one at that. As such - even if they may pledge that they will not re-offend, then the urge and leanings are still there, and any society who puts its honour on the promise of a paedophile is likely to be proven wrong, as there is always a chance that he may act on his most innate preferences.

    I'd like to see what you'd have to say if a convicted paedophile were to work at a place which your own children liked to frequent.

    If I can choose between two candidates who both have equally good merits, but one of them has been convicted of a crime, and I choose to hire the one with a clean record, would I be commiting a crime according to such anti-discrimination laws? I most certainly would, and a lawsuit would be sure to follow. This is how anti-discrimination laws work. If the minority person doesn't get the job, it's discrimination. I think it is wrong to put an employer in that kind of position where they are intimidated into hiring minorities to avoid expensive lawsuits or risk trials that consume time and money if they don't.
